Former Diamond Jack’s owners to pay more than $685,000 in tax fraud case



THE ALLEGATIONS. REPORTER WE ARE A DIAMOND JACKS, PART OF THE STATE FAIR FOR 40 YEARS. THREE OF THE OWNERS HAD BEEN ARRESTED FOR UPDATING SALES TAXES. THEIR SALOON IS A PERMANENT PART OF THE IOWA STATE FAIRGROUNDS. COURT DOCUMENTS SHOW THE OWNER WERE ALL ARRESTED ON MULTIPLE COUNTS OF FRAUDULENT PRACTICE, FIRST-DEGREE, AND SALES TAX EVASION WHILE OPERATING THEIR BUSINESS. THE DOCUMENTS DO NOT INCLUDE THE EXACT NUMBER OWED OTHER THAN TO SAY IT EXCEEDS $10,000 FOR EACH COUNT. THE PRACTICE COUNT STARTED IN 2016 AND GO UNT 2019. THE COUNT OF SALES TAX EVASION INCLUDED 201 2018, AND 2019. ALL THREE PLED NOT GUILTY. WE REACHED OUT TO THE IOWA STATE FAIR TO SEE IF THESE CHARGES WILL LEAD TO CHANGES AT T FAIR. THEIR STATEMENT READ, THE IOWA STATE FAIR IS AWARE OF THE CHARGES AGAINST THEM. IT IS THE SOLE RESPONSIBILITY OF CONCESSIONAIRES AS BUSINESS OWNERS TO ADHERE TO ALL RULES AND LAWS GOVERNING INDEPENDENT BUSINESSES. CONCESSIONAIRES HAVE AN 11 DAY CONTRACT THAT EXPIRE AT THE END OF EACH FAIR. THIS WOULD BE THE CASE FOR DIAMOND JACK’S ALONG WITH ANY OTHER STANCE OPERATED BY THEM DURING THE FAIR. Court documents filed in April show the three former owners of Diamond Jack’s will have to pay about $685,323 in their tax fraud case. In January 2020, owners Lance Benoit, Tamera Benoit and Tricia Behlers were charged with multiple counts of fraudulent practice and sales tax evasion. The charges stemmed from alleged fraudulent business practices regarding the popular Iowa State Fairgrounds concessions between 2016 and 2019. All three have since pleaded guilty to their charges. Lance Benoit will serve five years of probation while Tamera Benoit and Behlers will have two years.
